NSW - Bonds for Cattle and Sheep Lent from the Government Herds in 1811 and 1812

Following a "Tour of Inspection" of New South Wales, in late 1810 Governor Lachlan Macquarie issued a Government and General Order that Landholders of the "lower class" would be allowed to enter into bond for cattle and sheep from the Government Stores.  In 1842 the Attorney-General, on behalf of the Crown, brought an action against one of the parties who had entered into the bond agreement with the Government. Deemed of interest to the 'old hands' of the colony a complete list was printed in "The Australian" newspaper in February 1842, of the persons to whom the Government had lent cows and oxen in the years 1811 and 1812, for periods varying from eighteen months to three years.

Saturday, 15th December, 1810.

HIS EXCELLENCY the GOVERNOR being now returned from his late extensive Tour of Inspection through the various Districts of this Colony, where Agriculture and the Breeding of Cattle have occupied the attention of the numerous Settlers, deems it expedient to express freely his Sentiments thereon.—

HIS EXCELLENCY has been sorry to find, that the Landholders of the lower Class are in general very inadequately supplied with Horned Cattle, Sheep, or Goats; and being anxious to render them every Facility in his Power towards their deriving the Advantages of Live Stock, is pleased to make known to them, that such Persons as do not already possess those Comforts and Advantages, may be supplied from the Government herds with One Cow each, on the following Terms, namely, Payment to be made for the same in Grain or Money, as may be most convenient to the Purchaser, in 18 months after receiving her; but none need apply for such Indulgence, except those who can bring unquestionable Vouchers for their Honesty and Industry, and are ready to give good security for their retaining such Cow and her Offspring in their own Possession for the Course of Three Years from the Time of receiving her. — They may be further accommodated with a Proportion of sheep from the Government Flocks, under the same Restrictions. — With such Assistance from Government, and the steady Exertion of industry on the part of the Settlers themselves, the GOVERNOR is fully convinced that they may very shortly become as happy, thriving, and prosperous a People as any other throughout His Majesty's extensive Foreign Dominions.

We print in another column, a curious document, which, no doubt, will be looked at with interest by the "old hands'' of the Colony. It is a list of the persons to whom Government lent in the years 1810, 1811, and 1812, cows and oxen, for periods varying from eighteen mouths to three years, in some cases taking security for the repayment either in money or kind, in other cases taking, as it would appear, from the Return before us, no security at all.

Our readers are probably aware that the Attorney-General, on behalf of the Crown, has brought an action against one of the parties enumerated in the list, for the non-fulfilment of the contract entered into between the Government and the individual receiving conditional aid. The Chief Justice delivered, on Tuesday last, a decree, which is in favour of the claimant. Without any intention of going into the merits of this particular case, we must be permitted to say that, under all the circumstances, the course adopted by the Authorities is, at least, ungraceful, and deficient in magnanimity. It is inconsistent with the dignity of the Crown, that its proceedings towards individuals should be otherwise than characterised with a high-minded generosity, particularly in pecuniary maters. Here are a class of cases in which, from an undeniable laches on the part of Government, certain repayments have been unclaimed for a period of upwards of thirty years, Moreover, the Crown is entitled to recover, from each individual who has not fulfilled the terms of agreement, but small, and in a fiscal point of view, insignificant sums of money. It remained for Sir George Gipps, to do that which none of his predecessors have thought fit to do; namely, to act upon some old contracts "disenombed" to quote the felicitous expression of the Chief Justice "from the Commissariat Chest by some more diligent servant of the Crown." Certainly, we are not aware, however much the Ordinary Revenue may profit, that any additional glory will hereby rest upon his Excellency's administration.

Looking at the success of the above mentioned action at law, it is obvious that cæteris paribus there is nothing to prevent the Crown from proceeding against each of the individuals whose names appear in the list. And it is also clear that these parties have not much to expect from the Governor's forbearance. The hardship is greater with reference to the defendants, inasmuch as the Crown has law for nothing, whereas, the legal expenses on the part of the persons proceeded against, would press heavily upon them.

All, things considered, then, we will venture to suggest respectfully to His Excellency, that it would only be an act of usual grace and humanity if he would at once cancel all these old obligations. The purpose of Government, namely, that of nourishing the infant pastoral interests of the colony, has been thoroughly achieved; and really these small contracts ought to be suffered to pass into oblivion. Of the names of people in the list before us, probably one half are dead, and their representatives are unknown. Another large moiety are in a state of poverty; and to pick out for prosecution the few living solvent persons who appear in the record, would be harsh and invidious. We shall hope to hear of no more such actions as that lately brought in the Supreme Court. They confer no credit upon the prosecuting parties, whether they be the Secretary of State, the Commissioners of the Treasury, the Governor, or His Excellency's legal advisers. "Nescia repulsæ sordidæ, intaminatis fulgeo honoribus," should be the stainless motto of the Queen's Government both at home and in the colonies.
